Our compliance and file-checking requirements are set out within our Training & Competence Scheme and Mortgage Advice Standards.

TMG operates a risk-based approach, rather than checking a fixed percentage such as 10% of all cases. The minimum checking requirements for competent advisers are: 

• Green: one case checked every six months.  

• Amber: one case checked every three months.  

• Red: five consecutive case checks, plus any additional higher-risk cases identified.  

 

New advisers are subject to enhanced checking while they demonstrate competence, including checks on their initial cases. File-checking levels may also be increased where complaints, file outcomes, business patterns or other risk indicators identify a concern.  

 

Higher-risk cases may be selected for specific review, including interest-only, part-and-part, debt consolidation, lending into retirement and porting cases. We do not currently apply a separate automatic checking percentage solely because a case is classed as complex buy-to-let. However, complex BTL cases are considered within the overall risk-based approach and may receive additional scrutiny depending on the adviser, transaction and risks identified. 

 

Our Mortgage Advice Standards also set out the evidence and advice requirements for BTL cases, including rental income, affordability, sourcing, customer circumstances and the reasons supporting the recommendation. 

 

1. About these Terms 

These Terms and Conditions govern your access to and use of www.tmgfs.co.uk ("the Website"). 

The Website is operated by TMG Financial Services Limited, trading as TMG FS ("TMG FS", "we", "us" or "our"). 

By accessing or using the Website, you agree to comply with these Terms and Conditions. If you do not agree with them, you should not use the Website. 

These Terms apply only to the use of the Website. They do not replace the separate terms of business, service agreements, disclosures or other documents that may be provided to you if you proceed with a regulated financial service.

3. Purpose of the Website 

The Website provides general information about TMG FS and the financial services we offer. 

The Website also allows you to submit an enquiry so that an appropriately authorised individual can contact you. 

The Website does not: 

• provide personalised financial advice; 

• make a personal recommendation; 

• assess whether a product is suitable for you; 

• create a contractual relationship between you and TMG FS; 

• allow you to open an account; 

• allow you to upload documents; or 

• provide automated mortgage, affordability or insurance calculations. 

Submitting an enquiry does not commit you to using our services and does not require us to accept an instruction or provide advice. 

Personalised advice will only be provided after an appropriately authorised individual has gathered sufficient information about your circumstances, needs, objectives and preferences. 

 

4. Our Services 

Subject to the scope of our appointment by TMG Direct Limited, TMG FS may provide advice and arranging services relating to: 

• residential mortgages; 

• buy-to-let mortgages; 

• protection insurance; 

• general insurance; and 

• equity release, including lifetime mortgages. 

Our mortgage advice is provided from the whole of the market, subject to any lenders, products or transactions that are not available to mortgage intermediaries or are available only by approaching a lender directly. 

Our protection and general insurance recommendations are based on a fair and personal analysis of the market. 

The precise scope of the service offered to you will be explained before advice is provided. 

 

5. Commercial Finance Referrals 

TMG FS does not provide commercial finance advice directly through the Website. 

Where appropriate, we may refer a commercial finance enquiry to a third-party specialist. 

Any third-party specialist will be responsible for: 

• explaining its regulatory status; 

• explaining the services it provides; 

• assessing whether it can assist you; 

• providing any advice or recommendation; 

• issuing its own terms of business; and 

• explaining any fees or charges that may apply. 

A referral does not represent a recommendation or guarantee that the third party's services or products will be suitable for you. 

We may receive a referral fee or other payment from a third party. Where applicable and where required, this will be disclosed to you separately. 

 

6. Important Financial Information 

Information provided on the Website is general information only. It has not been prepared with your individual financial circumstances, needs or objectives in mind.

Mortgage warning 
Your property may be repossessed if you do not keep up repayments on your mortgage.

Equity-release warning 

A lifetime mortgage is a loan secured against your home. 

Taking equity release may: 

• reduce the value of your estate; 

• reduce the amount available to your beneficiaries; 

• increase the amount owed over time; 

• affect your tax position; and 

• affect your entitlement to means-tested benefits. 

You should obtain appropriate advice before entering into an equity-release arrangement. 

 

7. UK Transactions and International Access 

The Website may be accessed from outside the United Kingdom. 

However, the financial services described on the Website relate to products, property or transactions within the UK market. 

Accessing the Website from another country does not mean that our services are legally available or suitable in that country. 

The availability of advice or a product will depend on: 

• the location of the relevant property or transaction; 

• your residency and personal circumstances; 

• provider eligibility requirements; 

• the scope of our regulatory permissions; and

We may also receive commission or another payment from a lender, insurer, provider or third party. Further information about relevant commissions or payments will be provided during the advice process where required. 

Nothing on the Website should be treated as confirmation of the fee that will apply to your individual circumstances. 

 

11. Financial Promotions 

Website content relating to regulated financial products or services may constitute a financial promotion. 

Financial promotions issued by TMG FS are subject to the oversight and approval arrangements of TMG Direct Limited, where required. 

A financial promotion does not constitute a personal recommendation or confirm that a particular product will be suitable for you.

12. Accuracy of Website Information 

We take reasonable steps to ensure that information on the Website is accurate when published.

• changes made by an external platform;

We aim to provide a high standard of service. 

Complaints relating to regulated activities carried out by TMG FS should be handled in accordance with the complaints arrangements of our principal firm, TMG Direct Limited trading as TMG Mortgage Network.

Depending on the nature of the complaint and your eligibility, you may have the right to refer the matter to the Financial Ombudsman Service if it is not resolved to your satisfaction. 

Nothing in these Terms restricts your right to make a complaint or refer an eligible complaint to the Financial Ombudsman Service. 

 

20. Financial Services Compensation Scheme 

You may be entitled to compensation from the Financial Services Compensation Scheme, commonly known as the FSCS, if a regulated firm is unable to meet its financial obligations. 

Whether protection applies, and the amount of any compensation available, will depend on factors including: 

• the type of financial product or service; 

• which regulated firm is responsible; 

• the nature and date of the claim; 

• your eligibility; and 

• the FSCS rules applying at the relevant time. 

FSCS protection is not guaranteed in every circumstance.

21. Changes to these Terms 

We may update these Terms to reflect changes to: 

• the Website; 

• our services; 

• our business arrangements; 

• applicable law;

Your continued use of the Website after revised Terms are published will constitute acceptance of the revised Terms. 

 

22. Severability 

If any part of these Terms is found to be invalid, unlawful or unenforceable, the remaining provisions will continue in effect. 

 

23. No Waiver 

A delay or failure by us to exercise a right under these Terms does not mean that we have waived that right. 

 

24. Governing Law and Jurisdiction 

These Terms and any dispute or claim arising from them or your use of the Website are governed by the laws of England and Wales.
